Kelley and Scott Wolf’s divorce remains ongoing after her brief time in rehab.
Kelley, 48, entered rehab following a Sept. 2 court appearance, during which she informed a district court judge of her plan to enter a rehabilitation treatment center. By Tuesday, Sept. 9, she had exited rehab.
On Wednesday, Sept. 10, she appeared in court without legal representation, a source tells PEOPLE. Due to the lack of legal counsel present for Kelley, the judge would not rule on any matters, despite Scott’s lawyers’ requests for a full restraining order to be established.
The judge upheld parts of the Aug. 28 protective order that stated she cannot have any direct or indirect contact with her ex or her kids — the former couple shares sons Jackson, 16, and Miller, 12, and daughter Lucy, 11 — and Kelley still must remain at least 300 feet away from Scott.
However, Kelley and Scott, 57, are now allowed to communicate with each other via phone, as the judge said that is what’s best for their kids, per the source. Neither party is required to answer the other’s communication, especially if issues arise.
The next hearing in the divorce will be on Oct. 23, and the judge told Kelley she needs to retain a lawyer before that date while ordering Scott responsible for a portion of her lawyer, according to a source.

Kelley is facing three misdemeanor charges, all of which were marked as domestic violence-related, amid her divorce from Scott. The charges include misdemeanor electronic communications harassment and two charges of misdemeanor electronic disclosure of personal identifying information.
She was arrested on Aug. 26 on suspicion of electronic communication harassment and electronic disclosure of personal identifying information, the Summit County Sheriff’s Office told PEOPLE at the time.
The arrest followed days of apparent confrontational social media posts, allegedly doxxing her friends and family members. One post included Scott’s personal phone number with others, including communication with her and Scott’s three children.
Kelley’s social media usage violated the pair’s temporary stipulated agreement granted on Aug. 26, which contained a social media and press gag order for them to not post about each other, their marriage, their children or their divorce.
On Aug. 28, a new protective order was put into effect by Judge Richard Mrazik, ordering Kelley not to have any direct or indirect contact with Scott or their three children. Per the documents, she must remain at least 300 feet away from her ex and could only have contact with him during mediation sessions scheduled with a “Court Qualified Mediator” regarding their divorce or custody.
Scott was granted sole temporary custody of the kids on Aug. 26 after Kelley was placed under an involuntary 5150 hold at a Utah hospital.
The 5150 hold came after Kelley was detained by police while recording on Instagram Live on June 13.
Kelley filmed the moment officers arrived on Instagram Live, which was subsequently posted to her main account.
The clip showed police officers arriving and detaining her. The officer said that Kelley had “made some comments to your dad and comments to people that are concerning,” so they “want to make sure you’re okay.”
One of the officers told her she’s “not going to jail” and that they are going to get her “some help,” and she replied, “I know what I’m doing, I’ve done this. This is my job.”

Scott and Kelley met in 2002 and tied the knot in 2004. They celebrated their 20th wedding anniversary in May 2024.
In June, Kelley announced on Instagram that she and Scott had split, calling him “one of the best fathers I’ve ever known and one of the best partners a woman could have the privilege of sharing life with.”
“He is kind, thoughtful, funny, and beautiful in spirit,” she wrote. “We both look forward to an extraordinary life centered around the most extraordinary children. My priority has always been their wellbeing—and my own healing. That will never change.”

Scott called the split “the most difficult decision of my life” in his own statement, as he said their children “have always been, and continue to be, the loves of our lives and our every priority, so I kindly ask for privacy at this time as we help guide them through this new chapter.”
